MealFit Terms of Service

The present Terms of Service govern the use of the MealFit application and its related services. By creating an account, the user accepts these Terms in their entirety. Please read them carefully before proceeding with registration.

2. Acceptance of terms

By creating an account on MealFit, you accept these Terms of Service. If you disagree with any part of this document, please do not use the app.

These Terms constitute a binding agreement between you and the service provider. Together with the Privacy Policy (available at https://www.mealfitapp.com/privacy), they represent the complete agreement between the parties.

To use MealFit, you must be at least 16 years old. By creating an account, you confirm that you are at least 16 years of age.

3. Description of the service

MealFit is a mobile application that helps you:

• Plan your weekly meals
• Create and manage a recipe collection with nutritional data
• Calculate personalized portions based on your nutritional goals
• Generate shopping lists with required quantities
• Share meal plans with family members (Premium)

MealFit uses your physical data (weight, height, age, sex, lifestyle, and goal) to calculate your daily nutritional needs using the Mifflin-St Jeor formula. The processing of this health-related data is described in detail in the Privacy Policy.

4. Your account

4.1 Registration

To use MealFit, you must create an account by providing a valid email address, a display name, and a password. You are responsible for the accuracy of the information you provide and the security of your account.

4.2 Account security

You are responsible for:
• Keeping your password confidential
• All activities that occur under your account
• Notifying us immediately if you suspect unauthorized access (by writing to support@mealfitapp.com)

4.3 One account per person

Each person may have only one MealFit account. Creating multiple accounts or accounts on behalf of others is not permitted.

5. Free and Premium features

MealFit offers a free tier and a Premium subscription. Here's what each tier includes:

5.1 Free tier

• 1 user per plan
• Up to 5 custom recipes
• Access to non-premium preloaded recipes
• Weekly meal planning

5.2 Premium tier

• Unlimited users per plan (shared family plans)
• Unlimited custom recipes
• Access to all preloaded recipes (including Premium ones)
• Shopping list with PDF export
• Portions list with PDF export
• Shared plans with family members
• Data export

6. Subscription and payments

6.1 Pricing

The Premium subscription is available with the following plans:

Monthly: €6.99/month
Annual: €49.99/year

Prices include applicable taxes and may vary by region, as determined by Apple or Google.

6.2 Auto-renewal

Your subscription automatically renews at the end of each billing period, unless you cancel it at least 24 hours before the end of the current period.

For App Store purchases (iOS):
Payment will be charged to your Apple ID account at the confirmation of purchase. Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.

For Google Play purchases (Android):
Payment will be charged to your Google Play account at confirmation of purchase. Subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period. You can manage subscriptions in your Google Play Store account settings.

6.3 Important: uninstalling the app does NOT cancel your subscription

This is important: removing the app from your device does not automatically stop your subscription. To cancel your subscription, you must go to your Apple or Google account settings. If you simply uninstall the app, you will continue to be charged.

6.4 Access after cancellation

If you cancel your subscription, you will continue to have access to Premium features until the end of the period you've already paid for. After that, your account will revert to the free tier.

6.5 Price changes

We reserve the right to change subscription prices. In the event of a change:
• We will notify you at least 30 days in advance
• You will have the option to cancel your subscription before the new price takes effect
• The new price will apply from the next renewal period

6.6 Refunds

Refunds for in-app purchases are handled according to Apple and Google's policies:

MealFit cannot issue refunds directly, as payments are processed and managed by Apple and Google.

7. Right of withdrawal

Under Articles 52-59 of the Italian Consumer Code (Legislative Decree 206/2005) and the EU Consumer Rights Directive (2011/83/EU), you have the right to withdraw from the contract within 14 days of the purchase date, without providing any reason.

7.1 How to exercise the right of withdrawal

To exercise your right of withdrawal, you can send us an explicit communication at support@mealfitapp.com, indicating:
• Your name
• The email address associated with your account
• The date of purchase
• A statement that you intend to withdraw from the contract

7.2 Exception for digital content

Under Article 16(m) of the EU Consumer Rights Directive (and Article 59(1)(o) of the Italian Consumer Code), the right of withdrawal does not apply to the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and the consumer's acknowledgement that the right of withdrawal is thereby lost.

By completing the purchase of the Premium subscription and starting to use the Premium features, you expressly consent to the immediate performance of the service and acknowledge that this results in the loss of your right of withdrawal once performance has begun.

7.3 Withdrawal form

To make it easier to exercise your right, you may use the following form (not mandatory):

8. User content

8.1 Your content remains yours

The recipes you create, the images you upload, and the plans you compose are and remain your property. We do not claim any intellectual property rights over the content you create in the app.

8.2 License granted to MealFit

To host and display your content in the app (and in shared plans with other members), you grant us a non-exclusive license, limited to the duration of your account, to store, process, and display your content within the MealFit service. This license terminates automatically when you delete the content or your account.

We will never use your content for:
• Advertising purposes
• Training artificial intelligence models
• Sharing with third parties outside the service

8.3 MealFit content

The preloaded recipes, app design, logos, and MealFit trademarks are our property or used under license. Copying, modifying, or distributing them without our written authorization is not permitted.

8.4 Prohibited content

We ask you not to upload content that is:
• Illegal, offensive, or harmful
• In violation of third-party intellectual property rights
• Containing personal data of third parties without their consent

9. Shared family plans

Shared plans allow multiple family members to plan meals together. Here's how they work:

9.1 Roles

Plan owner: the person who creates the plan. Can invite and remove members.
Member: a person who accepts an invitation. Can view and edit the shared plan.

9.2 Data visibility

In shared plans, other members can see your name and the portions assigned to you. They cannot see your physical data, goals, or nutritional targets.

9.3 Leaving a plan

You can leave a shared plan at any time. Your personal data and custom portions remain associated with your account.

9.4 Owner account deletion

If the plan owner deletes their account, the shared plan is deleted. Members will be notified and can create a new plan.

10. Medical disclaimer

The following section is of particular importance and should be read carefully.

MealFit is not a medical device and does not provide professional medical, dietary, or nutritional advice.

The nutritional calculations provided by the app (calories, protein, carbs, fats) are estimates based on the Mifflin-St Jeor formula and the data you provide. These estimates:

• Are for informational and meal planning purposes only
• Do not replace the advice of a doctor, dietitian, or nutritionist
• Do not take into account specific medical conditions, allergies, intolerances, or particular clinical needs
• May not be accurate for every individual

We recommend that you:
• Consult a healthcare professional before making significant changes to your diet
• Do not rely on MealFit as your sole source of information for decisions about your diet or health
• Seek immediate medical advice if you have concerns about your diet or health

MealFit is not responsible for any consequences arising from dietary decisions made based on information provided by the app.

11. Limitation of liability

11.1 Service "as is"

MealFit is provided "as is" and "as available," without warranties of any kind, express or implied, except as required by applicable law.

11.2 Limitations

To the extent permitted by applicable law:

• We do not guarantee that the service will always be available, uninterrupted, or error-free
• We do not guarantee the absolute accuracy of nutritional calculations (they are estimates)
• Our total liability is limited to the amount of subscription fees you have actually paid in the 12 months preceding the event
• We are not liable for indirect, incidental, or consequential damages

11.3 Exceptions

Nothing in these Terms limits or excludes our liability for:
• Fraud or gross negligence
• Death or personal injury caused by our negligence
• Any liability that cannot be excluded under Italian law or European Union law
• Breach of consumer rights provided by law

Your rights as a consumer under the Italian Consumer Code (Legislative Decree 206/2005) and EU law are in no way affected by these Terms.

12. Service availability and modifications

We do our best to ensure a reliable service, but:

• We do not guarantee continuous and uninterrupted availability
• We may need to temporarily suspend the service for maintenance or updates
• We reserve the right to modify, add, or remove features

For material changes that significantly reduce the features included in your subscription, we will notify you with adequate advance notice and you will have the right to cancel your subscription without penalty.

13. Termination

13.1 By you

You can delete your account at any time from the app (Settings > Delete account). Account deletion results in the removal of all your personal data as described in the Privacy Policy.

If you have an active Premium subscription, access to Premium features will continue until the end of the paid period, after which there will be no further charges.

13.2 By us

We reserve the right to suspend or terminate your account in the event of a violation of these Terms, with reasonable notice (except in cases of serious violations requiring immediate action). In the event of termination by us, any unused subscription periods will be refunded proportionally.

14. Intellectual property

14.1 MealFit

The MealFit trademark, app design, source code, preloaded recipes, and all associated materials are our property or used under license. All rights are reserved.

14.2 Restrictions

You may not:
• Decompile, disassemble, or attempt to extract the source code of the app
• Copy, modify, or distribute any part of the app
• Use the MealFit trademark without written authorization
• Use automated tools to extract data from the app (scraping)

15. Governing law and jurisdiction

These Terms are governed by Italian law.

For consumers residing in the European Union, the mandatory provisions of the law of the consumer's country of residence also apply, to the extent they offer greater protection.

For any dispute arising from or related to these Terms, the competent court is the court of the consumer's place of residence or domicile, if located in Italy, as provided by Article 66-bis of the Italian Consumer Code.

For consumers in other EU Member States, the competent court is that of the consumer's place of residence, in accordance with Regulation (EU) No 1215/2012 (Brussels I bis).

16. Alternative dispute resolution

Before turning to a court, we encourage you to contact us to seek an amicable solution.

In accordance with Regulation (EU) No 524/2013, we inform you that the European Commission provides an online dispute resolution (ODR) platform, accessible at:

You may also contact an authorized mediation body, such as the conciliation service of your local Chamber of Commerce.

17. Force majeure

We shall not be liable for any failure or delay in the performance of our obligations arising from causes of force majeure, including but not limited to: natural disasters, pandemics, network outages, third-party server failures, acts of war or terrorism, and government orders.

18. Severability

If any provision of these Terms is found to be invalid, void, or unenforceable by a competent court, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.

19. Changes to Terms

We reserve the right to modify these Terms of Service. For material changes:

• We will notify you at least 30 days in advance via in-app notification and/or email
• You will have the right to reject the new terms and withdraw from the service without penalty
• Continued use of the service after the notice period constitutes acceptance of the modified Terms

20. Language

These Terms of Service are available in Italian, English, German, Spanish, French, and Portuguese. In the event of any discrepancy between the versions, the Italian version shall prevail.
